Acceptance of agreement
This End-User License Agreement (the "Agreement") is entered into between you (the "User") and the Car Diagnostics team (the "Licensor") with respect to the Car Diagnostics mobile application. By installing, opening or using the application you confirm that you have read, understood and agree to be bound by this Agreement. If you do not agree with any provision, do not install the application, stop using it and remove it from your device. By using the Application you also agree to the Privacy Policy published on this site, which describes what personal data are collected, how they are used, shared and retained, including the processing of vehicle data within AI features. The Application is intended for persons with full legal capacity under Ukrainian law who are at least 16 years old; minors may use the Application and its paid features only with the consent of a parent or legal guardian.
Definitions
"Application" — the Car Diagnostics mobile application for Android (package com.obd.diagnostics) including all updates. "Licensor" — the Car Diagnostics team. "User" — an individual or legal entity that installed or uses the Application, including a representative of an organisation that holds a corporate (Fleet) subscription. "Adapter" — a third-party OBD-II device (ELM327 Bluetooth/Wi-Fi) not supplied by the Licensor. "AI features" — fault analysis, predictions, recommendations, reports and chat generated by artificial-intelligence models.
License grant
The Licensor grants the User a limited, non-exclusive, non-transferable, non-sublicensable and revocable license to install and use the Application on the User’s own Android devices solely within the scope of the purchased subscription tier (personal, non-commercial use for the Free and Personal tiers; commercial use within the User’s own organisation for the Pro and Fleet tiers). The license is conditional on compliance with this Agreement and the Terms of service. All rights not expressly granted by this Agreement remain with the Licensor.
Restrictions
The User must not: reverse engineer, decompile or disassemble the Application; extract, copy, collect, scrape, systematically query or reproduce the diagnostic code interpretation dictionary or other proprietary data of the Application or the platform, including by means of automated requests to the platform’s server-side APIs or interfaces to reproduce, aggregate or reverse-engineer AI feature outputs; sell, rent, transfer or distribute the Application; circumvent technical limitations, subscription limits or usage metering; use the Application in any unlawful way.
Subscriptions and payments
Certain features are available under paid subscription tiers (Personal, Pro, Fleet) or against a prepaid balance in Ukrainian hryvnia that is redeemable solely for features within the Application. Top-ups and subscription payments are processed by external payment providers (Monobank, PrivatBank) on a browser checkout page. Paid subscriptions renew automatically at the end of each paid period; to stop further charges the User must cancel the subscription in accordance with the Terms of service before the next billing period begins. Commercial terms, the billing procedure, cancellation and the procedure for exercising the User’s statutory refund rights under Ukrainian consumer protection law are governed by the Terms of service published on this site.
Intellectual property
The Application, its code, design, trademarks, databases, the diagnostic code interpretation dictionary, and the format and structure of AI feature outputs are the property of the Licensor and are protected by intellectual property and trade secret laws. The Licensor grants the User a limited, non-exclusive, non-transferable licence to use the specific AI feature outputs received by the User under their subscription solely for the User’s personal or internal commercial needs in accordance with the purchased tier; resale, public distribution or transfer of such outputs to third parties is prohibited. This Agreement grants a right of use only and transfers no ownership rights to the User.
Vehicle safety and assumption of risk
The Application interacts with the vehicle’s electronic systems through an OBD-II Adapter. The User acknowledges and assumes all risk associated with such connection, including but not limited to: damage to the vehicle or its electronic control units, battery drain, Adapter incompatibility, and the consequences of any diagnostic, repair or operational decisions made on the basis of the Application’s data. Never use the Application while driving. In case of critical faults, consult a certified technician. Connection through an OBD-II Adapter may result in the reading of vehicle identification and diagnostic data; how such data are processed is described in the Privacy Policy.
AI output disclaimer
AI features (fault analysis, predictions, recommendations, reports, chat) are generated by large language models and may contain inaccurate, incomplete or outdated information. AI output is provided for informational purposes only and does not constitute professional vehicle repair or maintenance advice. The User bears all risk of relying on such output. To deliver AI features, vehicle data is processed using external AI infrastructure; the handling of such data, including transfers to third parties, is described in the Privacy Policy. Decisions involving road safety or vehicle maintenance must not be based solely on AI feature output; any critical or uncertain faults must be assessed by a qualified mechanic.
No warranty (AS IS)
To the maximum extent permitted by applicable law, the Application is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including warranties of fitness for a particular purpose, data accuracy, uninterrupted operation, absence of errors, or compatibility with any vehicle or Adapter. The Licensor does not warrant that the Application will detect all faults or that its readings are exhaustive or accurate. The foregoing disclaimer does not apply to the extent that liability cannot be excluded under mandatory applicable law.
Limitation of liability
All responsibility for the use of the Application rests fully and exclusively with the User to the maximum extent permitted by applicable law. Within those limits the Licensor shall under no circumstances be liable for any direct, indirect, incidental, punitive, special or consequential damages — including damage to the vehicle or equipment, consequences of diagnostic or repair decisions, inaccuracy of AI output, operation of third-party Adapters, loss of data or lost profits — even if the Licensor has been advised of the possibility of such damages. This limitation does not apply to harm to the life or health of the User caused by the Licensor’s wilful misconduct or gross negligence, or in any other case where limitation of liability is prohibited by applicable law; liability in respect of payment transactions is governed by the Terms of service and applicable consumer protection law.
Indemnification
The User agrees to indemnify and hold the Licensor harmless from any claims, actions, damages and expenses (including reasonable legal fees) arising out of the User’s breach of this Agreement, the User’s negligence or unlawful conduct, or the User’s violation of third-party rights. This provision does not limit or exclude the User’s rights as a consumer under applicable law.
Termination
The license terminates automatically upon the User’s breach of this Agreement; in that case no refund is due. The Licensor may revoke the license at any other time, and the treatment of any prepaid amount for the unused paid period in that case is governed by the Terms of service. Upon termination the User must remove the Application from all devices. The provisions on restrictions, intellectual property, disclaimer of warranties, limitation of liability, indemnification, severability and governing law survive termination.
Severability
If any provision of this Agreement is held invalid or unenforceable, it shall be enforced to the maximum permissible extent, and the remaining provisions shall remain in full force and effect.
Governing law
This Agreement is governed by the laws of Ukraine. All disputes arising out of this Agreement shall be resolved by the competent courts of Ukraine, except where applicable law in the User’s country of habitual residence grants the User the right to bring proceedings before local courts, in which case any relevant mandatory consumer-protection provisions of that law continue to apply. In case of any discrepancy between the Ukrainian and English versions of this Agreement, the Ukrainian version prevails.
Changes and contact
The Licensor may update this Agreement; material changes are announced in the application or by email at least 30 days before they take effect. If the User does not agree to the changes, the User may stop using the Application before the effective date and receive a pro-rata refund of any prepaid subscription for the unused period; changes affecting the amount or terms of subscription payments take effect no earlier than one full billing period after notice. Continued use of the Application after the effective date constitutes acceptance, except for changes affecting personal-data processing, which require separate consent as set out in the Privacy Policy.
